Pennsylvanians:

Call Senator Casey Today and Ask Him to Stop the Nomination of PA Judge Gene Pratter to the U.S. Court of Appeals for the Third Circuit

In her short tenure as a Pennsylvania district court judge, Gene Pratter has exhibited a willingness to prematurely dismiss the claims of civil rights plaintiffs, inhibit advocacy by their counsel, and thus deny plaintiffs access to a full and fair legal process. Yet President Bush has nominated Pratter to a lifetime position on the U.S. Court of Appeals for the Third Circuit – the federal court with appellate jurisdiction over PA, NJ and DE.

As the “home state senator” on this nomination, Senator Casey has the power to help stop Pratter's confirmation from moving forward. Senator Casey is home in Pennsylvania this week and needs to hear from you! Call him today at one of his local offices (or if you live nearby, pay him a visit!) and urge him to express his opposition to the nomination of Gene Pratter! Follow up your call by sending Senator Casey an email.

Issue At Hand

President Bush is using his remaining time in office to push the Senate into confirming a string of controversial nominees. Since becoming a Pennsylvania district court judge just three years ago, Pratter’s record demonstrates a disturbing trend to ignore legal precedent and deny full and fair judicial process for all Americans. Senator Casey must speak up in opposition to stop the Senate from moving forward and confirming Pratter.

Talking Points

If elevated to the U.S. Court of Appeals for the Third Circuit, Pratter would be given a lifelong position that makes instrumental and often final rulings on constitutional civil rights protections. Enforcement of our civil rights laws requires that plaintiffs be given a full and fair opportunity to present their claims. Pratter's record raises serious doubts as to whether she will protect these plaintiffs' access to a fair process. Her Senate confirmation would be a detrimental decision made to appease President Bush's unrelenting push for controversial judges.

Take Action

The Senate should refuse to process all controversial nominations at this late stage of the Bush presidency – especially nominations such as Pratter. The Senate must stop confirming controversial judges to positions that can affect our fundamental civil rights protections. Call Senator Casey today and tell him to stop the nomination of Gene Pratter to the Third Circuit!
